TRAVEL RISK ACKNOWLEDGEMENT/LIABILITY WAIVER FORM

 

Congratulations on taking the first steps towards booking an adventure with Alpenglow Travel! Just a few things to remember before we take off! Travelers are expected to conduct themselves in a professional and positive manner at all times. All Travelers are responsible for knowing the Booking Terms and Conditions of the Alpenglow Travel Getaways.

 

LIABILITY WAIVER / RISK ACKNOWLEDGEMENT:

 

I understand that participation in trip activities could involve risk of physical injury, illness, death or property loss, and despite safety precautions, Alpenglow Travel LLC cannot guarantee safety thereof, as all risks cannot be prevented. Alpenglow Travel, LLC does not provide health and accident insurance for trip participants and therefore it is ​required of all participants to secure his/her own travel insurance​. I understand that any medical expenses, property loss, or other personal expenditures that result during or from this trip, are to be borne by the Traveler. I also hereby consent, give authorization to, and release from liability; trip leaders to secure any emergency medical treatment in event I am unable to, and I agree to be responsible for the costs thereof.

I further acknowledge that if I drive my own vehicle (motorbikes included), or am a passenger in another’s private vehicle in connection with this trip, that Alpenglow Travel cannot be responsible for assuring the safety and reliability of such private transportation or driver, nor for any non-sponsored activities and travel that I might choose to participate in before, during or after the trip, and I therefore accept the risks and responsibilities associated with such private vehicle travel and activities.

 

In consideration for participating in the trip, YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE COMPANY, ITS OFFICERS, MEMBERS, AGENTS, CONTRACTORS, EMPLOYEES, VOLUNTEERS, GUIDES, AND OTHER REPRESENTATIVES (each a “company party” and collectively, the “company parties”) FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES (including but not limited to any exemplary, direct, indirect, incidental, special, consequential, punitive, or other damages, medical expenses, lost wages/income, loss of services, lost profits, property damage, pain, illness, and death) (collectively “liabilities”) WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR TRAVEL TO AND/OR PARTICIPATION IN THE RETREAT AND/OR ANY ACTIVITIES CONDUCTED IN CONNECTION THEREWITH, REGARDLESS OF WHETHER SUCH LIABILITIES ARE CAUSED BY THE NEGLIGENCE OF ANY COMPANY PARTY OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ANY COMPANY PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW.

 

You have been recommended to obtain travel insurance to cover against Liabilities resulting from trip cancellation or interruption, weather, natural disaster, strike, illness, job reasons, accident, sickness, evacuation, pre-existing medical conditions, baggage delay, loss, theft, and other Liabilities associated with travel and your participation in the trip.

In consideration of the opportunity afforded,​ ​with full knowledge and acceptance of the risks associated with this trip and any recreational activities noted within;​ ​and with full understanding of the above issues/conditions and risks​, ​I hereby release, indemnify and hold harmless Alpenglow Travel LLC, and any company staff members from all form and manner of risks inherent in, and from all claims, suits and demands of any nature arising from participation in said trip, or activities.

While on a Alpenglow Travel trip you will have the opportunity to engage in a number of activities that include, but are not limited to:

• Boat trips

• Hikes

• Surfing

• Safari Tours

• Sports

• Fitness Classes

• Swimming with Wildlife

• cooking Classes

 

YOU ARE AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO PARTICIPATING IN THE RETREAT, AND ACKNOWLEDGE THAT THIS IS A CONSENT, RELEASE OF LIABILITY AND A WAIVER OF YOUR LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH, PROPERTY DAMAGE, OR ANY OTHER LIABILITY, WHICH CREATES A CONTRACT BETWEEN YOU AND COMPANY. BY YOUR PAYMENT AND PARTICIPATION IN THE RETREAT, IT IS YOUR INTENTION TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND ANY OTHER LIABILITY UPON YOURSELF, TO THE EXCLUSION OF COMPANY AND ALL COMPANY PARTIES, AND TO EXEMPT COMPANY AND ALL COMPANY PARTIES FROM LIABILITY FOR, PERSONAL INJURY, PROPERTY DAMAGE, DEATH, OR ANY OTHER LIABILITIES.

 

I have thoroughly read and understand the preceding and forgoing information, to include any special risk or recreational risks included with this trip/travel as noted herein. I understand that all recreational activities are completely voluntary and based upon my own decision and I acknowledge that I may choose to decline these activities at any time. I hereby accept the associated risks and understand the precautions thereof.
